One of two Omaha men federally indicted for his involvement in a sprawling check fraud scheme pleaded guilty on Wednesday to one count of criminal conspiracy. Malik Washington, 27, and his co-defendant, 21-year-old Calvin Carter, are accused of attempting to deposit at least 60 counterfeit checks totaling more than $291,000 at various Omaha-area banks and credit unions between April 2021 and December 2022. They were initially charged in Douglas County with multiple felonies, but those charges were dismissed after the two were charged in an eight-count federal indictment last summer. Washington pleaded guilty to the conspiracy charge Wednesday, and the government agreed to dismiss seven additional counts of bank fraud and possessing counterfeit securities. Carter is scheduled to appear for a change of plea hearing on Thursday. Court documents allege that Washington, Carter and other associates would place advertisements on social media offering thousands of dollars to anyone with a bank account. People who agreed to participate would supply the men with their debit cards, PIN number and online banking information. After members of the conspiracy deposited forged business checks into the accounts, they would remove all of the funds through gift card purchases, ATM withdrawals and electronic transfers before the check could be flagged as fraudulent. According to state and federal court documents, the Douglas County Sheriff's Office began investigating the case in February 2022 after First National Bank of Omaha reported losing approximately $36,000 in two months from a series of similar forged checks. Twelve fraudulent business checks ranging from $3,000 to $7,000 were deposited into seven different FNBOs during the two-month period. They were either deposited at FNBO branches or through the bank’s mobile app. GPS coordinates captured on the banking app led investigators to a northwest Omaha home occupied by Carter, according to court documents. When a search warrant was executed on the home in February 2022, deputies found hundreds of pages of blank check stock, a safe monitored by a security camera, a shredder with a bin full of shredded checks and receipts for thousands of dollars worth of designer clothing and shoes. They also seized Carter’s phone and laptop, which allegedly provided additional evidence of text communications with co-conspirators and check printing software on his computer. Carter was arrested after the execution of the search warrant and was charged with forgery and criminal conspiracy in state court. Carter’s arrest did not mark the end of the investigation. In June 2022, FNBO again contacted the Sheriff’s Office to report an additional loss of more than $82,000 from forged checks that looked identical to those allegedly forged by Carter. Those checks, deposited between March and June 2022, purported to be for payroll from a business called “The Standard.” ATM cameras captured photos of the man who deposited the checks, and deputies identified him as Washington, according to court documents. A search warrant executed at Washington’s home did not locate any check forgery equipment, leading deputies to believe that someone else was supplying Washington with checks and directing him to deposit them. When Washington was arrested in June 2022, he was in possession of six debit cards not belonging to him, according to court documents. Washington will face a wide range of potential penalties when he is sentenced in March. The conspiracy charge that he pleaded guilty to carries up to 30 years in prison with no mandatory minimum, and a maximum fine of $1 million with no minimum. In Washington's plea agreement, the government agreed to recommend that he be sentenced "at the low end of the advisory guideline range." He will also have to pay a to-be-determined amount of restitution, which will be calculated considering "all charged and uncharged criminal conduct" alleged in the initial indictment.
